It’s time for opening arguments.
Maybe it’s a medical malpractice trial.
Maybe it’s a car accident trial.
Maybe it’s wrongful death trial.
In New York, in civil lawsuits, the attorney who represents the injured victim gets to make opening arguments first.
After I am done, the defense attorney will then have an opportunity to make opening remarks.
This gives each attorney the opportunity to explain to the jury what they believe the proof will show.
There is a formality with these trials.
We stand when the judge enters.
We stand when the judge leaves.
When an attorney makes opening remarks, traditionally lawyers tend not to make objections.
An attorney may need to make an objection during trial for many different reasons.
He may need to preserve his right to appeal a legal issue if he believes the judge’s ruling is incorrect. It is incumbent upon the attorney to stand up and object. Otherwise, he will be deemed to have waived his right to appeal that issue later on.
A lawyer who stands up to object during the middle of opening remarks of an opposing attorney may sometimes incur the wrath of the judge.
However, there may be instances where we have no choice but to stand up and object.
